What you purchase, word for word.

These terms describe what you purchase when you take out an Olive Pact guardianship, who the parties are, and which commitments we make and which we do not. They are written to be read: where contract language is needed, we use it; where plain Italian is enough, we use Italian.

1. Who we are

The Olive Pact service is managed by Fibi S.r.l. a socio unico, Via di Monte Donato 2, 40141 Bologna, VAT and Tax ID 03445431202, REA BO 519690 («Fibi», «we»). Fibi manages the guardianships, the website, the tree pages and communications with guardians, and is the party that enters into the guardianship pact with you.

The grove and the trees are owned by Babylon S.r.l., which has entrusted Fibi with the management of the guardianships on the trees in the grove. Fibi and Babylon are 100% owned by Xplode S.r.l., VAT ID 04043171208, REA BO 564698, which exercises direction and coordination over both.

2. What a guardianship is

The guardianship is a service: for ten years we associate a specific olive tree in the grove with your name, identify it with a plaque bearing your name, give you access to its dedicated page, and tell you its life story through photographs, videos and updates. In return, we commit to not removing that tree from the grove for the entire duration of the guardianship and to taking care of it.

What it includes

• The association of your name with a specific tree, chosen by you from those available in the chosen group, for ten years from the activation date.
• The right to name the tree: your own name, that of a loved one, or that of the recipient if the guardianship is a gift (article 9). The name appears on the plaque, the certificate, in the register and on the tree page.
• Registration in the guardians' register, with the tree number and the guardian's name.
• The guardianship certificate in PDF format, sent by email upon activation.
• A plaque with your name attached to the tree trunk, with a photograph on its page.
• Reserved access to the tree page, where we publish measurements, weather data of the grove, photographs, videos and updates, without a set schedule.
• Email communications about the tree, the grove and the project.

What it does not include

• No delivery of products: neither oil, nor olives, nor anything else. Products under the Olive Pact brand are sold separately, under their own terms, and do not necessarily come from the grove.
• No rights over the fruits of the tree, which remain with the owner.
• No guarantee of agronomic results (growth, production, survival): trees are living beings.
• No environmental credits or certification: the carbon data published on the tree pages are estimates based on scientific literature, declared as such.

3. Groups, prices and payment

The trees are divided into three groups based on trunk circumference. The guardianship fee is single, covers ten years and is paid in a single lump sum at the time of subscription:

• The giants: 1,000 euros;
• The large ones: 800 euros;
• The ones starting now: 500 euros.

Prices include VAT if applicable. There are no automatic renewals, annual fees or additional costs. Upon request, prior to subscription, we can arrange for the amount to be split into two or three payments; under no circumstances do we activate recurring charges.

Until the guardianships open, no payments can be made: the website only collects non-binding expressions of interest (article 11).

4. Duration, expiry and transfer

The guardianship lasts for ten years from the activation date indicated on the certificate. Upon expiry it does not renew and nothing is asked of you: the plaque and the name in the register remain as a memory, and the tree may be offered to a new guardian.

During the guardianship you can notify us in writing of a person to whom to transfer it (for example a child or a friend): we update the register, plaque and page access at no cost. The transfer does not extend the original duration.

5. Our commitments

For the entire duration of the guardianship we commit to:

1. not remove the tree from the grove: it will not be cut down, uprooted or transplanted by our choice;
2. tend to the tree according to good agronomic practices, with the timing and methods that the season and the plant require, and measure its circumference once a year at the time of year that permits it;
3. to maintain the plaque with your name and the tree's page, publishing photographs, videos and updates there whenever possible, and notifying you by email of any new updates published;
4. to inform you promptly, on the tree's page and by email, if the tree suffers damage or dies from disease, fire or other natural events beyond our control.

The commitment not to remove the tree also applies should ownership of the grove change: in such cases, we undertake to ensure that the new owner takes over the obligations relating to the trees under guardianship, and the guardianship continues under the same conditions.

6. If we do not keep our commitment · natural events

Refund. If, by our choice, your tree were to be uprooted and sold to a nursery or third parties during the guardianship, we will fully refund the amount paid, within 30 days of your request.

Natural events. Diseases, frosts, droughts, fires, weather events and any other cause beyond our control may damage or cause a tree to die. In such cases, no refund is due: nature will have run its course and you will have cared for it until its last day. We will inform you immediately with a photograph, and your name will remain in the tree's register.

7. Visits to the grove

The grove is private property and an agricultural workplace. Guardianship does not grant a right of access. Visits are only possible by appointment agreed with us, using your own transport and at your own risk; we do not organise guided tours or events.

8. Right of withdrawal

If you are a consumer residing in the European Union, you have the right to withdraw from the guardianship within 14 days of subscription, without giving any reason, by writing to us by email: we will refund the full amount within 14 days of communication. If in the meantime you have requested the immediate activation of the guardianship (plaque, certificate, page), we may withhold the proportional fee for the service already rendered up to the withdrawal.

9. Guardian's name, gift, use of name

At the time of subscription, you choose the name of the tree; if you do not specify one, the tree keeps its number until you choose one. The guardian's name you indicate will be written on the plaque, in the certificate and in the register. You can indicate the name of another person to whom you are gifting the guardianship, along with the date they should receive it; that person does not need to register or pay anything, and becomes the holder of the guardianship upon delivery. We do not accept, either for the tree or for the guardian, offensive names, trademarks or names of third parties without their consent; the tree's name can be changed once, upon request, with the replacement of the plaque at our expense.

10. Communications and content

We will write to you by email about the tree, the grove, the project and Olive Pact branded products. You can ask us at any time to stop receiving commercial communications; communications necessary for the guardianship (for example, damage to the tree) will continue. The photographs, videos and texts on the tree pages are ours: you can share them for personal, non-commercial use.

11. Preview and expressions of interest

Until the guardianships open, the site is a preview of the project. The images are illustrations, the tree «Vittoria» is an example, and the numbers and prices indicated are the proposal we are defining. By leaving your name in the form, you assume no commitment and pay nothing: we will notify you when the grove is purchased and the real trees are photographed, and those who signed up first will be able to choose first.

12. Applicable law and jurisdiction

These terms are governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction; consumers residing in the European Union can also use the European Online Dispute Resolution platform. In all other cases, the Court of Bologna has jurisdiction.
